    Sad, but true :(

    (And I don't feel the need to argue or debate or say more in this thread to justify this obvious fact.)
    Too bad you don't feel the need to learn the facts either. Just where are these viruses going to come from? How will they get executed/installed? Answer: They will not come because they can't execute. That's what a walled garden is: protection from the wild.

    I never said Apple going after Woolworths for their logo was a good move.

    My only point in this whole discussion is Apple is not all sweet and innocent like so many like to think and defend them to the death. They have done some pretty lame things and filed frivolous lawsuits. And as an aside, The Beatles Let It Be album had a red apple logo in the center instead of the usual green.

    I still don't understand why nobody has managed to make a viable alternative to Microsoft Office, esp. Microsoft Excel. Apple's iWork is fine, but clearly not enough and of course there is no Windows version. Google is too obsessed with the cloud and ad thing and didn't make Google Docs a local app for Windows / Mac / Smartphones with Dropbox like cloud capabilities. :(

    So Microsoft can continue to be fed with its Windows / Office monopolies for the foreseeable future.


    because you don't take down an established company going head to head with one of their core products. your product will have to be a lot better to compete, and it will be too expensive.

    if you want to win you need to wait for the tech cycle to change and take advantage of it. like apple did with the PC tech cycle giving way to smaller more mobile devices. give it a few years and they may start to replace PC's, but most likely will just live in unison

    MS Office has so much features that no one person uses all of them, but the entire user base uses all the features.

    Thunderbolt is not a supplement to DisplayPort. It is a downgrade to DisplayPort.

    I'd disagree based on the last demo by intel.

    I am curious about something. Intel is apparently having difficulty dealing with ATI, which is owned by AMD. Is this a problem for Apple that is limited to notebooks only? It seems like the new MBP doesn't have this same problem, except in the 13" model. Is this problem going to affect Apple's desktop machines? Or is it only limited to the very small laptops and perhaps the Mac Mini? I am just curious because it doesn't appear that the MBP 15 & 17" are effected. I do hope that this makes sense. I have been waiting to see the next versions of the Mac Book and the iMac. I would like to have a portable and I don't care or need a laptop that is a quarter of an inch in thickness or if it weighs a pound more than a Mac Book Air.

    Not quite. There are at least two other options. Fair use, and exhaustion/implied license/first sale doctrine.

    The use is almost certainly fair use, and Apple's rights may very well be exhausted under the first sale doctrine. It's a thorny question of law since there is nothing in the Mac OS license that makes it clear what you can do with those icons. Apple would have been better off putting something in the development agreement about not being able to use representations of Macs, etc. But they didn't.

    So your argument is that since a court of law would find this to be copyright infringement, it's covered by the development agreement.

    My opinion, as an I.P. lawyer, is that it's not at all clear that it's copyright infringement, that most people would think it probably isn't, and that therefore the development agreement does not at all clearly forbid this sort of thing.


    P.S.: You're saying developers just need to read the agreement. I'm saying they need to read the agreement, go to law school, and guess how Apple will interpret the facts.
    Which law firm please. We'd all like to know for future reference, who to not trust our cases with. While most law has to do with the letter of the law, jury trials often are won or lost based on what the jury believes to be the intent or spirit of the law.

    The british common law legal system was never intended to be like this. The lawyers have destroyed and twisted it beyond all recognition. It was originally supposed to be based on judeo-christian morals and ethics. There is not supposed to be a grey area. You are either deliberately infringing on the rights of others or you are not. The original intent was to have a court case as the last resort where parties would first try to solve the problem by talking to each other, then go to arbitration and then court as a last resort.

    Screenshots on other sites show airflow displaying a Firefox icon. That icon is definitely not covered any implied license through use of the API on the mac. Care to explain that to us Mr. Lawyer?

    I don't claim to know a thing about trademark law, but looking at this simply I find it difficult to understand how the term "Windows" can become a trademark but "App Store" cannot.

    Amen, brother... M$ wants to have it their way but not allow anyone else to do the same.

    Either the video playback code was improved to be less power hungry (maybe it uses less CPU, maybe it doesn't need to spin the disk as much), or an improved video chip was put in which uses less power.

    The phone's look is indeed very similar.

    Of course, Samsung's Android phone has many additional items such as their pulldown notification shade with built-in radio and orientation lock controls... which many people would love for Apple to copy.

    The tablet is a different matter, and doesn't have the same look.

    this is definitely a style over functionality....how da heck do you dial a number with clickwheel?

    Nokia actually has a phone with clickwheel and no keypad, the 7380. Anyway, the Apple Phone does have a keypad as well.

    If taking cues from the MacBook Air means having a tapered front, then no thanks.

    I have to say the current design is pretty good, and I'm not sure what else they could do--but I've always thought that in the past, and they've usually blown me away each time. So, I'm excited to see what they are planning.

    I'm sort of on the fence about the optical drive. I don't use it every day, but it's definitely nice to have it built-in when I need it. I'm not a fan of having more cords and external devices on my laptop.

    It just occurred to me, that in Leopard iChat has a thing called Remote Desktop Express. This could easily be used in the new device to send Front Row to the TV!

    Apple, I'm sure is thinking ahead. Or they plan on releasing the new iChat on the 12th.

    As Jobs said in his most recent keynote more money in R&D isn't everything, and if he says so i believe him.

    Unless Woo has something extraordinary under his sleeve - which he doesn't cause if he did he would not need more money - i see Creative in the same position in a couple of years from now. And then they'll try to sue somebody else.

    Does anyone think we should be hitting 4ghz about now?

    I mean weve been stuck on 2.x for ages. Whats the deal? A 4ghz quad would be frickin awesome. :confused:

    Would you rather a Pentium D @ 4Ghz or, Core 2 Extreme @ 2.93Ghz or even Core 2 Duo 2.4Ghz?

    Granted, the Pentium D example was a little bad and although its been hammered a billion times already, let me just say, Gigaherz is only a part of the equation when it comes to speed of modern CPU's.

    According to Anadtech, Conroe blows eveything else out of the water in regards to sheer performance. Give me a Core 2 Architecture anyday.

    I hope somehow apple creates forum software with spotlight search so as soon as I start typing something it searches through 500 pages of posts and on the right side of the screen will show similar comments, who posted it, and on what pages similar comments are/where posted.
